Knesset Finally Ratifies Repealing Reasonableness Test's Law

Jul 25, 2023 12:02 pm

The Supreme Court of Occupation's activity is restricted by the draft law of the reasonableness test, which was finally repealed by the Israeli Occupation Knesset.

The "reasonableness test" enables the Israeli Occupation Court to keep track of and evaluate governmental decisions and to overturn certain of them if they are not in the public interest.

The "reasonableness test" law gives the judiciary the legal and administrative power to overturn government decisions that are in conflict with the public interest or fail to give the public interest the proper weight, including decisions regarding appointments to the public service from ministries and other organizations.

By repealing this law, the Supreme Court's ability to influence governmental choices, especially the appointment of the ministers and their deputies, will be reduced.
